 Freedom isn't free. Nor is it available for everyone at any price.

If a lawyer is going to have a blog, then the terrorism cases are what I should be writing about. Unfortunately, I don’t have time just this second. So instead, I will give it short shrift and let my feelings ooze from the text.

Let me get this straight:

The Supremes decided in Rasul v. Bush that a foreign national detained at the Guantanamo naval base is entitled to habeas relief as if he were being held in the United States itself.  Since Gitmo is, for all intents and purposes, a permanent U.S. facility this was the only reasonable decision.  Still, that didn’t prevent a 5-1-3 vote. Of course, any hopes that this right would be immediately meaningful were dashed when the decision in Hamdi came out. (Negative points for the majority for a confusing and unnecessarily complicated job of distinguishing the Eisentrager precedent.  A better opinion would have made the dissent look foolish instead of merely wrong.)

In Hamdi v. Rumsfeld the Court decided that a U.S. Citizen captured abroad and held in the U.S. as an enemy combatant, the detainee can protest the fact of his designation as an enemy combatant (but not any specific military charges) in a proceeding where (a) hearsay is admissible and (b) the government gets all presumptions.  Interesting notion of due process. You don’t get charged with a crime and the “evidence” against you actually requires scare quotes.  (Bonus points to Scalia and Stevens for being the only Justices to get this right and holding that actual charges must be brought if Hamdi is to be detained. Serious negative points to Thomas for believing that war justifies the creation of martial law.)

Finally, and most offensively, the Supremes committed the most egregious punt of the term.  After punting on the Pledge of Allegiance and Energy Task Force cases, the biggest shank off of the Court’s foot came today in Rumsfeld v. Padilla.  Instead of answering the question concerning the liberty of all Americans within our nation’s borders, the Court chose to dismiss the case on obscure venue grounds. Yes, Padilla can refile in South Carolina. In the meantime, he remains in prison without any charges and without any recourse. And for all conspiracy theorists out there, all of the Republicans (unless people still want to argue that Souter is a Republican) voted to decide this case in such a way as to make it unlikely to be resolved before the election.

What a bunch of fucking pussies.

I admit, I actually like that Dick Cheney is the sort of guy who will tell someone “Fuck yourself.” It makes him seem like a real person.

At the same time, as Tim Grieve at Salon notes, if this really what U.S. international relations is like, no wonder the rest of the world hates us. (Link may require watching a short commercial.)

 Are you busy on Saturday night?

I can’t wait for Rick to post again, so I guess I just have to put this up now.

My stand-up “career” resumes in earnest this week.  Tuesday night is the finals of the Funny Jew contest at Gotham. I haven’t performed since the Funny Lawyer contest so I have scheduled a warm-up performance for this Saturday night at The Improv.  It appears that the finals for the Funny Jew contest are sold out, so this would be a good show to go to. I still need a few more confirmed guests on my (remember: Charles Star) ledger to get the stage time, so come on out.  The reservation line at The Improv is 212-629-1781.

The Improv is at 318 W. 53d between 8th and 9th. The show starts at 7, but they recommend that you get there when the doors open at 6:15. This guarantees [for you] a better seat and [for the club] a drink in you before the comedy starts. The show is $12 plus a two-drink minimum.

 Not Your Average Teenage Wizard

For those who liked the Harry Potter books but found the first movie uninspired ... for those who can’t get enough Harry Potter ... for those who fail to understand the phenomenon completely but appreciate a good laugh ... even for those who flat-out hate Harry Potter, you are in for a treat. 

Daniel Radosh explains the wonder that is Brad Neely’s Wizard People, Dear Reader in today’s Salon. (Yes, you have to watch a short commercial for most of Salon’s content. Stop complaining. If it really bothers you that much, click “Day Pass” and open another browser window while the commercial plays.)

The short version: Wizard People, part spoof and part homage, is a companion CD synched up scene by scene to the DVD of Harry Potter and the Sorcerers Stone. It has to be heard to be believed. (There are better explanations than mine at Stay Free! (scroll down to April 9, 2004), in Daniel’s article, and in an article from a few weeks ago that originally ran in the NYT.

The CD can be downloaded for free (but donations accepted) from Illegal Art.  It is a large file, so have 2 CD’s handy for the download.  Remember: Just because a free lunch is available doesn’t mean you have to take it.

Also, to the folks out in Austin or thereabouts (yes, I mean you Jeremy and Scott), you can go to a live screening.

 Dreams do come true

7 months later, my wish has been granted.  I pick up my new RX-8 later this week.  Pictures to follow.  How strange is it that I have the same car as Instapundit?  Perhaps stranger is that anyone should care what car either of us drives.  But still, both of us will probably continue to write about our cars.  Mine is named Banzai.

 "Hi. You Are Reading A Blog."

I just got back from a trip down South through Tennessee, Alabama (for about 20 minutes), Mississippi, Arkansas and Texas.  I can’t believe TMFTML beat me to the punchline. Can’t I even experience my own life without someone else beating me to publication?

Anyway, I’m stuck making fun of Orbitz. I used Orbitz to purchase my tickets and asked for Orbitz Customer Care to call me if there were any changes to my itinerary.  I received two calls.

The first call told me that my departure would be delayed.  This would have been helpful had I not actually been sitting on the plane twenty minutes past my scheduled departure waiting for Delta to resolve an unspecified fuel issue. (It sure sounded like “My younger brother borrowed the car and returned it with an empty tank,” but who knows. We all chipped in for gas and the plane took off.)

On the return trip I was standing at the baggage carousel when Orbitz called to tell me that my plane arrived early.

 I'd Like To Thank The Academy ...

Here is the short version: 65 people turned out to Stand-Up NY to see me last night at the Funniest Lawyer contest.  I won.  First prize was a $100 gift certificate at Circuit City and paid weekend dates at the club.  The former is nice; the latter is mind boggling. I figured it would be months before I got a paid gig.

Thanks to everyone who came out.  I’ll post a longer entry when I wake up.

 One Down, One To Go

It’s too late and I’m too tired to blog the details, but my first appearance as a stand-up comic went at least as well as I could have expected.  I finished tied for second in my preliminary heat at the “Funniest Amateur Jewish Comic” contest at Gotham on Tuesday night.

By finishing second I advance to the finals on June 29th.  Details to follow.

Expect a longer post about this in the future, but for now I have to get some sleep so that I can be awake enough tomorrow to tinker with the material and add another five minutes for the “Funniest Lawyer” contest at Stand-Up New York.
